Police Officer Under Investigation After Violent Arrest in Albuquerque
Albuquerque, NM – An Albuquerque Police Department (APD) officer is under investigation following a violent arrest captured on video Saturday evening that has sparked outrage and calls for accountability from community leaders. The incident, which occurred near Central Avenue and Coors Boulevard, involved the apprehension of a 26-year-old man, identified as Joseph Garcia, for allegedly jaywalking and resisting arrest.
Furthermore, The video, widely circulated on social media, shows an APD officer repeatedly striking Garcia while he is on the ground. Witnesses can be heard yelling at the officer to stop. According to police, the incident began when officers observed Garcia crossing the street outside of a designated crosswalk. They allege that Garcia refused to provide identification and became combative when officers attempted to detain him.
“We understand the community’s concern regarding this incident and want to assure the public that we are taking this matter very seriously,” said APD Chief Harold Medina in a statement released Sunday. “An internal investigation has been launched, and the officer involved has been placed on administrative leave pending the outcome.”

Civil rights advocates are questioning the use of force. “The level of force displayed in the video is deeply disturbing and raises serious questions about the officer’s training and judgment,” stated Eleanor Rivera, Executive Director of the New Mexico chapter of the American Civil Liberties Union (ACLU). “We demand a thorough and transparent investigation into this incident and call for immediate reforms to APD’s use-of-force policies.”
This incident occurs amidst ongoing scrutiny of police practices in Albuquerque. In recent years, the APD has faced criticism and federal oversight due to a history of excessive force and civil rights violations. A 2014 settlement agreement with the Department of Justice mandated a series of reforms, including improved training and accountability measures. While some progress has been made, critics argue that significant challenges remain.
“This is yet another example of why the DOJ needs to come back to Albuquerque and really monitor the situation here,” said local activist Lorenzo Montoya during a press conference held Sunday afternoon near the site of the arrest. “The police have not learned anything. They are still terrorizing our community.”
According to Bernalillo County Sheriff’s Office records, Garcia was booked into the Metropolitan Detention Center on charges of resisting arrest, aggravated battery on a police officer, and disorderly conduct. As of Monday morning, Garcia remains in custody. His bail has been set at $5,000.
The investigation is ongoing. The Albuquerque Police Department’s Internal Affairs unit is conducting a full review of the incident, including body camera footage and witness statements. The District Attorney’s office will review the findings of the investigation to determine whether criminal charges are warranted against the officer.
